PARTICIPATION IN A REFERENDUM IS A CONSCIOUS CHOICE OF EVERYONE

On January 20, 2022, the President signed Decree No. 14 “On the appointment of a republican referendum”. In accordance with it, the republican referendum on amendments and additions to the Constitution of the Republic of Belarus will be held on February 27, 2022 |
The draft constitution was developed by the Constitutional Commission, established in March 2021, which included 36 people. The Commission was headed by the Honored Lawyer of Belarus, Chairman of the Constitutional Court Piotr Miklashevich. The commission also included representatives of legal science, government agencies, public associations, various sectors of the economy and the social sphere.
On December 27, 2021, the draft amendments and additions to the Constitution were published for public discussion, and over 7,000 proposals were received by the National Center for Legal Information within a month.
In accordance with Art. 111 of the Electoral Code of the Republic of Belarus, a referendum is a way for citizens of the Republic of Belarus to make decisions on the most important issues of state and public life.
According to Part 1 of Art. 4 of the Electoral Code of the Republic of Belarus, citizens of the Republic of Belarus who have reached the age of 18 have the right to participate in a referendum. Citizens recognized as legally incompetent by a court, persons held by a court sentence in places of deprivation of liberty, persons in respect of whom, in accordance with the procedure established by the criminal procedural legislation, a measure of restraint - detention has been chosen, do not participate in the referendum.
On January 21, 2022, the draft amendments and additions to the Constitution, submitted to a referendum, were published. This draft is attached to Decree No. 14.
Decree No. 14 also contains a question to be answered in a referendum: “Do you accept amendments and additions to the Constitution of the Republic of Belarus?”.
According to part 4 of Art. 3 of the Electoral Code of the Republic of Belarus, the referendum is held by universal, free, equal and secret ballot.
The decision of the referendum in the Republic of Belarus is binding and, according to Decree No. 14, comes into force 10 days after its official publication. Since July 1, 2012, the only source of official publication of legal acts registered in the National Register of Legal Acts of the Republic of Belarus is the National Legal Internet Portal of the Republic of Belarus parvo.by - the main state Internet resource in the field of law and legal informatization.
